Privacy Policy
1. Introduction
This Privacy Policy describes how JSL Lead Enterprises, LLC, a Texas limited liability company that owns and operates the My NIL Guide application (the "Application," and referred to as "we," "us," or "our"), collects, uses, stores, and protects information when you use our platform. JSL Lead Enterprises, LLC is the entity responsible for your information under this Privacy Policy. By using the Application, you agree to the collection and use of information in accordance with this Privacy Policy. This Privacy Policy is incorporated into and subject to our Terms of Service.
2. Information We Collect
Information You Provide Directly:
- Account Information: When you create an account, we collect your name, email address, and any information provided through our authentication provider (Clerk).
- Disclaimer Acknowledgments: When you sign the disclaimer, we collect your full legal name, email address, signer role (athlete or parent/guardian), IP address, user agent, and timestamp.
- Profile Information: Athletic profile data including level of play, sport, division, year in school, and home state. When you are signed in, this information is synced to and stored on our servers so it is available across the devices you use (such as our web and mobile apps).
- User Content: Content you choose to enter or upload in the Application, such as contact and support-team entries, campus visit notes, deal and offer records, optional self-entered wellness check-ins (personal journal-style entries, not medical records), and images you upload (such as a personal logo or profile photos). When you are signed in, this content is synced to and stored on our servers under your account.
- Purchase Information: If you purchase a subscription, the transaction is processed by Apple's App Store or Google Play (through our subscription management provider, RevenueCat). We receive subscription status information (such as which plan is active), but we never receive or store your credit card or banking details.
Information Collected Automatically:
- Usage Data: We may collect information about how you interact with the Application, including pages visited and features used.
- Device Information: Browser type, operating system, and device identifiers used for security and platform optimization.
- IP Address: Collected for security purposes and to support compliance record-keeping of disclaimer acknowledgments.
Information We Do Not Collect:
- Social Security numbers or government-issued identification numbers
- Financial account numbers, credit card numbers, or banking information
- Medical or health records (optional wellness check-ins are self-entered journal entries you provide, not medical data collected from you or any health service)
- Precise geolocation data
3. Data Storage and Cross-Device Sync
Your athlete profile, recruiting preferences, portal data, school comparisons, and language preferences are cached locally on your device for fast, offline-friendly access. When you are signed in, this data is also synced to and stored on our servers and associated with your account so it stays consistent across the devices you use (for example, our web app and our mobile app). This data:
- Is stored both locally (browser local storage or, on mobile, on-device storage) and, when you are signed in, on our servers under your account
- Remains under your control — you can clear local copies by clearing your browser or app data, and you can request deletion of server-stored copies by contacting us (see "Your Rights" and "Contact Information")
- Is associated with your authenticated account and is not made available to other users unless you explicitly share it through the Application's sharing features
- Local-only copies may be lost if you clear your browser or app data; signing back in restores data that was synced to your account
4. How We Use Your Information
- To provide and maintain the Application: Including personalizing content based on your profile and generating AI-powered analyses.
- To process disclaimer acknowledgments: Maintaining legally required records of user acknowledgments for compliance purposes.
- To authenticate users: Verifying your identity through our authentication provider.
- To improve the Application: Understanding how features are used to enhance the user experience.
- To ensure security: Detecting, preventing, and addressing technical issues, fraud, or unauthorized access.
- To comply with legal obligations: Responding to lawful requests from government authorities or as required by law.
5. AI-Generated Content and Data Processing
When you use AI-powered features (such as draft prediction, college fit analysis, note summarization, or training search), the profile information and inputs you provide are sent to third-party AI service providers for processing. We use commercially available AI services, and:
- We do not use your data to train AI models
- AI processing is performed in real-time and outputs are not permanently stored on our servers unless you explicitly save them
- You should not input sensitive personal information (Social Security numbers, financial account numbers, passwords) into AI-powered features
- AI-generated outputs may be inaccurate, outdated, or inappropriate and should be independently verified
6. Third-Party Services
- Authentication Provider (Clerk): Manages user accounts and authentication. Subject to Clerk's own privacy policy.
- AI Service Providers: Process AI-powered features. Subject to their respective privacy policies and data processing agreements.
- Subscription Management (RevenueCat) and App Store Payment Processors (Apple, Google): Manage subscription purchases and entitlements. Payment details are handled entirely by Apple or Google; we and RevenueCat receive only subscription status and anonymized transaction identifiers.
- Hosting and Infrastructure: The Application is hosted on cloud infrastructure. Server logs may be collected for security and debugging purposes.
We do not sell, rent, lease, or trade your personal information to third parties for marketing purposes.
7. Data Retention
Server-Stored Data: Your synced profile and portal data are retained on our servers for as long as your account remains active, or until you request deletion. Disclaimer acknowledgment records are retained indefinitely for legal compliance and record-keeping purposes. Account authentication data is retained as long as your account remains active.
Locally-Stored Data: Profile data and application preferences cached in your browser's local storage or your mobile device's on-device storage are retained until you manually clear them or clear your browser/app data.
Deletion Requests: You may request deletion of your server-stored data by emailing us at support@nilguideapp.com or using our contact page. Please note that we may retain certain data as required by law or for legitimate business purposes (such as disclaimer acknowledgment records).
8. Data Security
We implement reasonable technical and organizational measures to protect the security of your information. However, no method of transmission over the Internet or electronic storage is completely secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.
9. Children's Privacy
This Application may be used by minor athletes with parental or guardian consent and supervision. We do not knowingly collect personal information from children under 13 without parental consent. If a parent or guardian becomes aware that their child under 13 has provided us with personal information without consent, they should contact us, and we will take steps to remove such information.
For users between 13 and 18, we strongly recommend parental or guardian involvement in all interactions with the Application, particularly when signing disclaimer acknowledgments or using AI-powered features.
10. Your Rights
Depending on your jurisdiction, you may have certain rights regarding your personal information, including:
- The right to access your personal information
- The right to correct inaccurate personal information
- The right to request deletion of your personal information (subject to legal retention requirements)
- The right to object to or restrict processing of your personal information
- The right to data portability
- The right to withdraw consent (where processing is based on consent)
To exercise any of these rights, email us at support@nilguideapp.com or use our contact page. We respond to verified requests within the time required by applicable law.
11. Do Not Track Signals
We do not currently respond to "Do Not Track" browser signals or mechanisms. We do not track users across third-party websites for advertising purposes.
12. Updates to This Privacy Policy
We may update this Privacy Policy from time to time. We will notify you of any material changes by updating the "Last Updated" date at the top of this policy. Your continued use of the Application after the updated Privacy Policy becomes effective constitutes your acceptance of the updated policy. We encourage you to review this Privacy Policy periodically.
13. Governing Law
This Privacy Policy is governed by the laws of the State of Delaware, consistent with the governing law provisions in our Terms of Service.
